Prospective ODR providers should use the form below

 

[ODR provider] wishes to partner with the Economic Committee (EC) under the terms of the APEC ODR Collaborative Framework and Model Procedural Rules and be included in the APEC Directory of ODR providers.

[ODR provider] hereby certifies its compliance with all the terms of the APEC ODR Collaborative Framework and Model Procedural Rules including but not limited to:

  1. Keeping all information confidential and maintaining secure databases and websites (Collaborative Framework para. 5.1);
  2. Charging reasonable fees proportionate to the amount in dispute (Collaborative Framework paras.4.2, 6.2);
  3. Providing for the use of online negotiation, mediation and arbitration (Collaborative Framework, para. 1.2);
  4. Providing to the APEC EC and other providers data on the success of the pilot each June and December (APEC ODR Collaborative Framework, Paragraphs 4.3-4.5).

 

Note: The Economic Committee retains the discretion to remove a provider from its list, if it is found to be not in compliance with the APEC ODR Collaborative Framework and Model Procedural rules (APEC ODR Collaborative Framework, paragraph 4.6).
